Terms of Service

These Terms of Service (the “Terms”) apply to the products and services of Elevate Vibez Inc., doing business as Vibez 5D (“Vibez 5D,” “Elevate Vibez,” “we,” “our,” or “us”), including our websites, mobile applications, AI-assisted tools, educational content, coaching programs, courses, social media pages, and other online services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. Please read these Terms carefully. If you do not agree to these Terms, do not use the Services.
1. Agreement to Terms
By using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you are entering into these Terms on behalf of another person or entity, you represent that you have the authority to bind them to these Terms.
Certain disputes must be resolved through binding arbitration on an individual basis, as described in Section 16 below.

We may provide additional terms for certain products, services, events, or programs. Any additional terms are incorporated into these Terms and will be controlled in the event of a conflict.
3. Eligibility & Accounts
Eligibility: You must be at least 18 years old to use the Services. We do not knowingly collect or process information from anyone under the age of 18. By using the Services, you represent and warrant that you are at least 18 years old.
Account Creation: Some features may require an account. You agree to provide accurate, current information, keep it updated, and maintain the confidentiality of your login credentials.
Responsibility: You are responsible for all activity under your account and agree to notify us immediately at hello@vibez5d.com if you suspect unauthorized access.
4. Subscriptions & Payments
Some Services require a paid subscription or one-time purchase. If you purchase a subscription or other paid Service:
Recurring Subscriptions: If your subscription is set to renew, it will automatically continue for the subscription period you select until canceled. You authorize Vibez 5D to charge your designated payment method for the applicable fees and any taxes, using trusted third-party payment processors such as app stores or payment platforms.
Billing Through Third Parties: If you purchase through a third-party platform, that platform’s billing terms and cancellation procedures apply. You must cancel directly with the platform to avoid renewal.
Refund Policy: Except where required by law, payments are non-refundable. If refunds are available, they will follow the policies of the payment platform you used to purchase the Services.
Price Changes: We may change our subscription fees at any time, with advance notice. If you do not agree to the new fees, you may cancel before the change takes effect.
Eligibility: Because our Services use AI-driven guidance, you must be at least 18 years old to purchase or subscribe. By completing a purchase, you confirm you meet this requirement.
5. Intellectual Property
All content, frameworks, AI models, courses, programs, graphics, videos, and other materials provided by Vibez 5D are owned or licensed by us and protected by intellectual property laws.
You are granted a limited, personal, non-commercial, revocable license to use the Services for your individual benefit.
You may not copy, reproduce, sell, distribute, or create derivative works from our materials without our written permission.
6. User Content
You retain ownership of any content you submit to the Services but grant us a non-exclusive, royalty-free, worldwide license to use, display, and promote it in connection with the Services.
You must have all necessary rights to the content you provide and ensure it does not violate laws or infringe on others’ rights.
7. Community Guidelines
You agree not to:
Use the Services to harass, abuse, threaten, or harm others.
Upload or share unlawful, obscene, defamatory, discriminatory, or otherwise harmful content.
Interfere with or disrupt the operation of the Services.
Attempt to reverse engineer, hack, or bypass security features.
We reserve the right to remove content or suspend accounts for violations of these Terms.
8. Wellness & Medical Disclaimer
The Services are for educational, personal growth, and wellness purposes only.
Vibez 5D is not a medical or mental health provider and does not diagnose, treat, or cure conditions.
Nothing in the Services is a substitute for professional medical, psychological, or therapeutic advice.
Always seek qualified professional guidance for any medical or mental health concerns.
Do not use the Services while driving, operating machinery, or performing tasks requiring focus.
9. Third-Party Content & Links
We may include links or integrations with third-party services. We are not responsible for their content, policies, or practices. Your use of those services is at your own risk and subject to their terms.
10. Termination
We may suspend or terminate your account and access to the Services at any time for violations of these Terms or for any lawful reason.
You may cancel your account at any time by emailing hello@vibez5d.com, but this does not cancel any active app store subscriptions—you must cancel those directly.
11. Indemnification
You agree to defend, indemnify, and hold harmless Vibez 5D, Elevate Vibez Inc., and our officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services or violation of these Terms.
12. Limitation of Liability
To the fullest extent permitted by law, Vibez 5D will not be liable for indirect, incidental, special, or consequential damages, even if advised of the possibility. Our total liability will not exceed the amount you paid us in the 12 months prior to the claim or $50 USD, whichever is greater.
13. Arbitration & Governing Law
Arbitration: Except where prohibited by law, disputes will be resolved through binding arbitration on an individual basis under California law.
Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law rules.
14. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms and update the “Last Updated” date. Your continued use after changes means you accept the updated Terms.
15. App Store & Marketplace Terms
A. Apple App Store
If you download or use our iOS app:
These Terms are between you and Vibez 5D, not Apple.
Apple is not responsible for the app or its content.
Any claims, maintenance requests, or warranty issues must be directed to Vibez 5D at hello@vibez5d.com.
You must comply with Apple’s App Store Terms of Service when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
B. Google Play Store
If you download or use our Android app from Google Play:
These Terms are between you and Vibez 5D, not Google.
Google is not responsible for the app or its content.
You must comply with the Google Play Terms of Service and Google Play Business and Program Policies.
Google is a third-party beneficiary of these Terms and may enforce them against you.
